THE SUPREME Court on Monday asked the Army to produce the notification which said that women officers were not to be allowed permanent commission in the armed forces. The bench comprising Justice J.M. Panchal and Justice Gyan Sudha Misra granted the army a period of one week to submit the notification.
The army had moved to the apex court after the Delhi High Court passed a judgement in favour of granting permanent commission to women officers. Earlier, Parag Tripathi, Additional Solicitor General (ASG) submitted that rules permitted that permanent commission for women could only be given in the wings of Judge Advocate General and education department.
Justice Misra also asked that why were women cadres in the army not being granted the permanent commission whereas it is being granted in the Air Force now.
On which Parag Tripathi submitted that Section 12 of the Army Act, 1950 was not in breach of Article 14 of the Constitution since it was protected by Article 33. He also said that if women were given permanent commission it will affect the disciplinary structure of the army.
