Supreme Court questions CVC's appointment


THE BLOWS and bashings never seem to end for the government by the Supreme Court. Post a series of misendeavours, the apex court raised a question regarding the appointment of Chief Vigilance Commissioner (CVC), P J Thomas. The Supreme Court said that how could he work as a CVC as there is already a criminal case pending against him. P J Thomas was charged by the Kerala police for his role in the alleged palm oil import scam.

 

Justice S H Kapadia said that when Thomas works as a CVC he will deal with corruption matters. There will be an allegation against him every time. How will he function? And, in every matter he deals with, he will face embarrassment and under these circumstances we want to know if he will be able to function as CVC.

 

"Without looking into the file, we are concerned that if a person is an accused in a criminal case how he will function as CVC," a bench headed by Chief Justice Kapadia observed after Attorney General G E Vahanvati placed the file in a sealed cover.

 

The bench after seeking time for reviewing the file came up with the issue after two weeks. A bench comprising Justices K S Radhakrishnan and Swatanter Kumar said that they will sit together and go through the file once again.
