A WRIT petition has been filed in the Allahabad High Court, by Dr Nutan Thakur against producers of Tees Maar Khan, Twinkle Khanna, Shirish Kunder and Ronnie Screwvala and Director of Tees Maar Khan, Farah Khan and producers of Dabangg and director of Dabangg and Central Board of Film Certification (Censor Board) and Union of India through the Secretary of Information and Broadcasting. Ashok Pandey is the advocate counsel of the petitioner.
The reasons for the petition have been cited as the indecent, immoral and vulgar songs, dialogues and visual representations in the film which have a direct bearing on the viewers. The dissemination of such vulgarity in dialogues, songs and scene which starts off way before the film is actually released does not set a good example before the viewers which vary in age and understanding, the petition says. Other reasons include the dissemination of songs and other things before receiving the certificate from the board which is illegal.
This is completely against sections 3(1), 4, 5(A), 5(C) and 5(E) of the Cinematography Act 1952 because in many cases such songs, dances, scenes, dialogues do not get certificated later on but by that time it has been publicly exhibited to a very large extent. Hence, the petitioner has requested the High Court to direct the Censor Board and Ministry of Information and Broadcasting to intervene and issue directives to the filmmakers in all the languages and all other concerned bodies like the Television channels, radio stations, audio cassette and video cassette companies not to display anything (including songs, dances, dialogues, audio inputs, sequences, promos or other such materials of the film) before the Censor Board has issued the required certificate to the respective films.
Thakur has also condemned the use of names like “Munnis” and “Sheila” in the latest item songs Munni Badnam Hui and Sheila ki jawaani as it creates a lot problems for living women with the same names. They are molested, teased and harassed just for the coincidence. Such songs are provocative and against decency, morality and public order and which can incite commitment of offences. This is against the provisions of section 5(B)(1) of the Cinematographer Act.
Hence, she has requested to issue orders to immediately stop the public exhibition of these two songs. As an interim relief, the petitioner has requested ordering the respondents to stall the release of the Hindi film ‘Tees Maar Khan’ as long as the song ‘Sheila ki jawaani’ is not removed from the film and to stop the screening/ public exhibition of the Hindi film ‘Dabangg’ as long as the song ‘Munni badnaam hui’ is not removed from the film. The matter shall come for hearing on January 3, 2011.
